This is the User Agreement for A Lovely Place to Stay (referred to as ‘A Lovely Place to Stay/Kite Cottage/we/us’) of www.alovelyplacetostay.co.uk, an on-line website facility offering details on cottage facilities, booking information and is operated by A Lovely Place to Stay.
Before using this website (‘Site’) please read through these terms and conditions and print a copy for future reference.
General
A Lovely Place to Stay reserve the right to change these terms and conditions at any time. It is your responsibility to read the terms and conditions on each occasion you use this website and your continued use of the website shall signify your acceptance to be bound by the latest terms and conditions. Any such changes will take effect when posted on the website (see date at the top of the page).
Payment Terms
A deposit of one third the total booking fee is payable at the time of booking with the balance payable no less than eight weeks before the holiday start date. These payments may be made by bank transfer or by cheque but please allow time for payment to reach us when paying the balance as late payment may result in your booking being cancelled in which case the deposit may not refunded.We will do everything we can to contact you prior to cancelling your holiday but it is your responsiblity to ensure that payment is made by the required date.
Cancellation
In the event that after booking Kite Cottage you wish to cancel, if it is outside eight weeks from the start date then the deposit will be repaid. If you wish to cancel after the balance has been paid thus within eight weeks of the start date, we will refund the balance, with the deposit only being returnable if we manage to fill the week. We strongly recommend taking out insurance.
Holiday Insurance
Booking Kite Cottage does not include Travel or Cancellation Insurance in any way. Travel and Cancellation Insurance must be taken out seperately and from another source.
Notices
Unless otherwise expressly stated in these terms and conditions, all notices from you to us must be in writing by email to enquiries@alovelyplacetostay.co.uk or to our contact address: 55, Bowden Road, Templecombe, Somerset BA8 0LF and all notices from us to you will be displayed on our website from time to time or sent by email.
Invalidity
If any part of these terms and conditions is unenforceable (including any provision in which we exclude liability to you) the enforceability of any other part of these conditions will not be affected.
Third Party Websites
The Site may include links to other web sites or material which are beyond its control. A Lovely Place to Stay is not responsible for the content on the Internet or World Wide Web pages on its Site or any other site outside this Site.
Third Party Rights
Except for our affiliates, directors, employees or representatives, a person who is not a party to this agreement has no right under the UK Contracts (Rights of Third Parties) Act 1999 to enforce any term of this agreement but this does not affect any right or remedy of a third party that exists or is available apart from that Act.
Entire Agreement
We make no representations or warranties about the accuracy completeness or suitability for any purpose of the information and related graphics published on our website. From time to time our site may contain technical inaccuracies or typographical errors. All liability of A Lovely Place to Stay howsoever arising from any such inaccuracies or errors is expressly excluded to the fullest extent permitted by law.
Notwithstanding the foregoing, nothing in these terms and conditions is intended to limit any rights you may have as a consumer under applicable local law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.
Intellectual Property
You acknowledge and agree that all copyright, trademarks and all other intellectual property rights in all materials and/or content made available as part of your use of this Site shall remain at all times vested in us or our licensors. You are permitted to use this material only as expressly authorised by us or our licensors.
You acknowledge and agree that the material and content contained within this Site is made available for your personal non-commercial use only and that you may only download such material and content for the purpose of using this website. You further acknowledge that any other use of the material and content of this Site is strictly prohibited and you agree not to directly or indirectly breach our intellectual property rights.
